1. Acceptance of Terms

By downloading, installing, accessing, or using the TeeSocial mobile application (the "App") or the website at teesocialgolf.com (the "Website"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and TeeSocial LLC ("TeeSocial," "we," "us," or "our"). If you do not agree to these Terms, do not use the App or Website.

2. Description of Service

TeeSocial is a social golf application that provides GPS course tracking, real-time stat tracking, course ratings, social features, multiplayer game modes, and related services. The App is available on iOS and Android devices. TeeSocial may offer both free and premium subscription-based features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Eligibility

You must be at least 13 years of age to use TeeSocial. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you have the legal capacity to enter into this agreement.

4. Account Registration

To access certain features of TeeSocial, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TeeSocial reserves the right to suspend or terminate accounts that violate these Terms.

5. User Content

You retain ownership of all content you post, upload, or share through TeeSocial, including but not limited to photos, text posts, stories, round data, scores, comments, and profile information ("User Content"). By posting User Content, you grant TeeSocial a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to post your User Content and that your User Content does not violate any third party's intellectual property rights, privacy rights, or any applicable law.

6. Prohibited Conduct

You agree not to use TeeSocial to:

a) Post content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.

b) Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

c) Attempt to gain unauthorized access to other users' accounts or any part of the Service.

d) Use the Service for any commercial purpose without our prior written consent.

e) Interfere with or disrupt the Service, servers, or networks connected to the Service.

f) Upload viruses, malware, or any other harmful code.

g) Scrape, data mine, or use automated means to collect information from the Service.

7. Subscriptions and Payments

TeeSocial may offer premium subscription plans ("Premium") that provide access to additional features. By subscribing to a Premium plan, you agree to the following:

a) Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan selected).

b) Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

c) Payment is processed through the Apple App Store or Google Play Store. All billing inquiries should be directed to the respective platform.

d) TeeSocial reserves the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Intellectual Property

The TeeSocial name, logo, branding, design, software, and all related intellectual property are owned by TeeSocial LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission. The TeeSocial "TS" monogram, Masters yellow and Augusta green color scheme, and all associated visual elements are trademarks of TeeSocial LLC.

9. GPS and Location Data

TeeSocial uses GPS and location services to provide course tracking, distance measurements, and nearby course features. By using these features, you consent to the collection and use of your location data as described in our Privacy Policy. GPS accuracy may vary depending on your device, environment, and conditions. TeeSocial does not guarantee the accuracy of distance measurements or course data and is not responsible for decisions made based on GPS information provided by the App.

10. Course Data

TeeSocial provides access to a database of golf course information, including hole data, par values, course ratings, slope ratings, and tee information sourced from third-party providers. While we strive for accuracy, we do not guarantee that course data is complete, current, or error-free. Course conditions, layouts, and ratings may change without notice. Users may contribute course data through mapping features; such contributions become part of the TeeSocial database.

11. Handicap Calculator

TeeSocial provides a handicap calculator based on the World Handicap System (WHS) formula for informational purposes. The handicap index calculated by TeeSocial is not an official USGA or GHIN handicap and should not be used for official tournament play or handicap verification. For an official handicap index, please register with your local golf association or GHIN.

12. Third-Party Services

TeeSocial may integrate with or link to third-party services, including but not limited to Apple Sign In, Google OAuth, Google Maps, OpenStreetMap, and push notification services. Your use of these third-party services is subject to their respective terms and privacy policies. TeeSocial is not responsible for the availability, accuracy, or practices of any third-party services.

13. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, available at teesocialgolf.com/privacy-policy. By using TeeSocial, you consent to the practices described in the Privacy Policy.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TEESOCIAL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEESOCIAL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO TEESOCIAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

16. Indemnification

You agree to indemnify, defend, and hold harmless TeeSocial LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

17. Termination

We may suspend or terminate your access to TeeSocial at any time, with or without cause, with or without notice. You may delete your account at any time through the App settings. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Providence County, Rhode Island.

19. Changes to Terms

TeeSocial reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Website and/or through the App. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
